Welcome to the website for America's Political Communication System™. America's Political Communication System™ will provide its services with the following terms of privacy.

COMPANY SPECIFIC DEFINITIONS

Company: America's Political Communication System™ Incorporated

Website: Any public Internet/World Wide Web service purchased by America's Political Communication System™ and actively used for the purpose of the Company's business. Specifically (at this time), this refers to all content provided under the domain name http://www.americapcs.com.

User: Any individual that visits, uses or participates in any website, web application or other electronic communication interface developed by America's Political Communication System™.

Member: Any individual that is a User and has a registered account with America's Political Communication System™ that allows that individual to use the special Membership features of our technology and website

Host: Includes (but not limited to) an individual, association, organization, political committee, etc that has purchased a Host account from America's Political Communication System™ which allows rental of a personal Host Forum and access to all the applications and tools for managing that Host Forum.

Host Forum: An area of the website specific to a particular Host. For Members and Users, this area provides access to applications such as (but not limited to) the Collaborative Conversation™ Control Panel, Message Boards, Contributions Collection for the Forum Host, etc.

America's Political Communication System™ will collect information from Members such as first name, last name, address, city, state, zip code, email address, phone number, gender and date of birth. America's Political Communication System™ will also collect a preferred Username and password from the User, which will grant that individual access to his/her Member account.

America's Political Communication System™ will also collect voting information for Members who participate in the Collaborative Conversation™ polling system.

America's Political Communication System™ will collect information from Hosts such as first name, last name, address, city, state, zip code, email address, phone number, committee specific information and website URL. America's Political Communication System™ will also collect a preferred Username and password from the Host, which will grant that individual access to the Host's account.

America's Political Communication System™ will collect and store all content created through Forum Message Boards.

America's Political Communication System™ will collect credit card information or checking information for Members who use the Contributions Collection service. Any credit card information collected will be transmitted through a secure credit card transaction service. America's Political Communication System™ WILL NOT store or keep any credit card or checking information within the Company's own databases or records.

DISCLOSURE OF INFORMATION TO THIRD PARTIES

America's Political Communication System™ will not share, rent, sell or otherwise disclose personally identifiable information to third parties without obtaining Member's or Host's consent. America's Political Communication System™ will disclose to third parties only:

A ) demographical information based on Member voting results (Member identity WILL remain anonymous in ALL demographical information released)
B ) information to the financial institution that processes Host or Member credit card transactions;
C ) information that does not include personally identifiable information; and/or
D ) information that is already publicly available.

NO LIABILITY FOR ACTS OF THIRD PARTIES

Computers, computer networks and transmission made by means of the Internet and computer networks cannot be made absolutely secure.

AMERICA'S POLITICAL COMMUNICATION SYSTEM™ WILL HAVE NO LIABILITY FOR DAMAGES ARISING FROM DISCLOSURE OF INFORMATION AND/OR REGISTRATION DATA ARISING FROM:

A) Member OR Host's DISCLOSURE OF SUCH INFORMATION IN PUBLIC AREAS;
B) ERRORS IN TRANSMISSION;
C) UNAUTHORIZED ACTS, INTRUSIONS OR INTERCEPTIONS; AND/OR
D) COMPLIANCE WITH THIS PRIVACY POLICY

ADVERTISEMENTS, FORUM POSTING AND PUBLIC MEMBER COMMUNICATION

All user advertisements and postings to public areas of the website including without limitation Forums, Chat Rooms and Bulletin Boards (collectively, the "Host Forum"), can become public and, therefore, care should be taken in disclosing personal information. Postings made in the Host Forum Areas may not be deleted by Users or Members. When communicating directly with another Member, Members may exchange personally identifiable information at Member's discretion.

AMERICA'S POLITICAL COMMUNICATION SYSTEM™ DISCLAIMS ALL LIABILITY FOR DAMAGES ARISING FROM ANY User'S OR Member'S DISCLOSURE OF PERSONALLY IDENTIFIABLE INFORMATION.

Any information disclosed to other Members, Hosts or third parties, in the Public Areas, through email or outside of our system, can be used by others and may result in unsolicited email messages or other communication from third parties.

MEMBER AND HOST ACCESS TO COLLECTED INFORMATION

Members may access his/her registration data at any time through the Member Account Management areas of the website. This area is password-protected. Once a Member registers, he or she may review and change certain fields of personally identifiable information such as first name, last name, email address, city, state, zip code, phone and country. Please be sure to update email address changes promptly.

Hosts may access account registration data at any time through the Host Account Management areas of the website. This area is password-protected.

America's Political Communication System™ can not be held responsible for lost communications due to outdated or invalid Member e-mail information.

CONTROL OF PASSWORD

Passwords should be:

A) non-obvious;
B) regularly changed; and
C) not disclosed to any third parties.

If a third-party learns of a password, the password's owner may lose control over his/her postings and/or personally identifiable information, and may be responsible for actions performed with his/her account. If, for any reason, a password is suspected to have been compromised, it should be changed immediately. Members and Hosts are responsible for maintaining the confidentiality of account name and password. User shall be responsible for all uses of its account, whether or not authorized by Member or Host. Members and Hosts agree to immediately notify America's Political Communication System™ of any unauthorized use of its account.

LOST OR STOLEN INFORMATION

America's Political Communication System™ does not store Member credit card information in any of its own databases or records. All credit card transactions are processed through a secure, third-party, transaction processing system. In the event of a lost or stolen credit card, User should contact his/her bank or financial instituition to cancel any transactions processed through our website.

PARTNERS AFFILIATES AND LINKS

America's Political Communication System™ may become affiliated with many other sites, businesses and service providers, all of whom have privacy practices independent of America's Political Communication System™. America's Political Communication System™ disclaims any responsibility or liability for any other sites" privacy policies or activities. Once a User or Member follows a hyperlink within the website or utilizes or purchases any third party service or product, the User or Member may be entering a relationship with a third party or another website where America's Political Communication System™'s privacy policy does not apply.

DISCLOSURE IN EVENT OF IMPROPER USE OR MISCONDUCT

Not withstanding anything herein to the contrary, America's Political Communication System™ shall be permitted to disclose Member and Host information and registration data, including personally identifiable information, to third parties as follows:

A) in response to a request by law enforcement authorities;
B) in response to any court-ordered subpoena or other process under color of law; and/or
C) when America's Political Communication System™ reasonably believes that a Host, User or Member has breached the terms of service agreement with America's Political Communication System™ , violated the rights of any third party, or violated any law, statute or regulation.

OWNERSHIP OF INFORMATION

All information collected, including Registration Data, is the property of AmericaPCS, Inc., and is subject to and protected by state and federal law.

UPDATES

AmericaPCS, Inc. reserves the right to change or update at any time this Privacy Policy, or any other AmericaPCS, Inc. policy or practice. Any changes or updates will be effective immediately upon posting to the AmericaPCS, Inc. Website.

By transmitting information via this website, you grant to America's Political Communication System™. an unrestricted irrevocable license to use, reproduce, display, modify, perform and distribute such information and AmericaPCS, Inc. is free to use the information, including any ideas, know-how or techniques contained therein free of charge for any purpose whatsoever.
